Have you been the victim of a criminal act that violates life, health or freedom, or are you a surviving family member of a person who has been a victim of such a criminal act?


If so, the NCA can collect the compensation/legal costs awarded to you in the case, but ONLY in such cases.

We cannot help you to collect other forms of compensation/legal costs.

What do you do? Relevant forms
1. Fill in the form. If more than one person owes you money, you must fill in one form for each of them.

Have you been awarded compensation in a criminal case?
In that case, you do not have to send us anything.
The police will send the case to the NCA.

2. Enclose documentation:

  • a copy of the whole judgment
  • confirmation from the District Court that the judgment is final and enforceable (valid)
If you have tried to collect the claim yourself, please enclose papers confirming this (this could extend the limitation period which means that the claim can still be collected).
 
3. Send the form and documentation to us by post. By doing so, you authorise us to collect the claim on your behalf.  

Who can we collect claims for, and in which cases can we collect claims?

The NCA can collect compensation and/or legal costs awarded in civil cases where someone has been a victim of a:

  • Criminal act that violates life, health or freedom.

We can collect claims either on behalf of this person or on behalf of the person's surviving family members.

If so, you do not have to send us anything. The police will send the case to the NCA.

The law does not apply to everyone who has a claim for compensation in the same case. We can only collect claims for the person who has suffered the injury (the victim), or the victim's surviving family members. Others who have claims for compensation as a result of the same criminal act (for example an employer or insurance company), must collect their claims in the normal way.

Do you have to pay us to collect the claim for you?

No, there is no charge.

But in countries other than Norway, Sweden, Iceland and Finland, we have to use a debt collection agency to collect the claim. This is expensive, and all costs relating to the collection of the claim must be deducted from the payments received before we pay you. We therefore consider on a case-to-case basis whether it is worthwhile to send the claim to a debt collection agency.

The Act entered into force on 1 June 2013.

If you are awarded or have previously been awarded compensation in a civil case of this type, the NCA can collect the compensation on your behalf.

How do we collect the compensation?

We can collect compensation on behalf of a victim or a surviving family member through voluntary collection or legal enforcement of the claim. Legal enforcement means that we can make deductions from pay or National Insurance benefits, or establish a charge on assets owned by the person who owes you compensation. If the person who owes compensation is due a tax refund, we can ask the tax collection office to withhold the money to cover the claim (set-off against tax).

It is important to note that, even though the person who owes compensation receives pay or National Insurance benefits, he or she must have enough money left to live on –  subsistence. If they will not have enough money left to live on, we cannot collect the claim until their financial situation changes. We cannot pay you the amount in advance.

What happens if the person who owes you compensation lives abroad?

The person who owes you compensation can agree with us to make part-payments (pay in instalments) even if he or she lives abroad. If the person who owes you compensation does not pay the claim voluntarily, we have limited possibilities to start legal enforcement proceedings if the person in question does not have any income or assets in Norway.
